In March 2019, Dr. James Dobson and his ministry, the Dr. James Dobson Family Institute (JDFI), won a judicial victory over the federal abortifacient mandate. In 2011, the Department of Health and Human Services under President Obama began requiring religious ministries to cover FDA-approved contraceptives in their employee health plans. Some of those contraceptives operate abortifaciently, i.e., by preventing implantation of a fertilized egg. Dr. Dobson challenged the mandate in federal court in Colorado, arguing that HHS and other federal agencies violated the Religious Freedom Restoration Act when they forced his ministry to facilitate health coverage for abortion-inducing drugs and devices. The court agreed and ordered that a permanent injunction be entered against the mandate in favor of Dr. Dobson and JDFI. Dr. Dobson and JDFI are represented by Nussbaum Speir and the Alliance Defending Freedom. See press coverage in the Gazette, Denver Post, and Fox News.
